Australian Ugg Brand Owner Deckers Sued Emu Trademark Infringement

Deckers filed a complaint with the federal court of California, Losangeles, claiming that Emu deliberately misled consumers on the AOL shopping website and sold it to non Deckers companies.
AngelMartinez, chairman and chief executive of Deckers, said: "the success of UggAustralia has made many counterfeit products on the market deliberately misleading consumers. Ugg will crack down on such companies as Ugg infringing trademarks such as Emu and the products that are copied from Ugg like Bearpaw, and we will also severely punish the numerous counterfeit products sold on the Internet. Because the success of UggAustralia is based on the brand's reputation on consumers. This is our most valuable asset and must be well maintained.
The two companies are focusing on the word "Ugg". Ugg interprets "snow land" in Australian language. Emu regards it as a general word. In Australia and New Zealand, more than 70 companies use "Ugg" to register their brands. Deckers just made the word popular around the world, so there is no commercial infringement.
Deckers requires Emu to pay 3 times the proceeds and the lawyer's fee for this lawsuit.
